HCMC PRIVACY POLICY

How We Protect Your Information

1. Who We Are

Honor Code Medical Consultants ("HCMC," "we," "us," or "our") is a medical device and biologics distributor serving healthcare providers, hospitals, and clinical facilities across the United States. This Privacy Policy describes how we collect, use, and protect information submitted to us through honorcodemedical.com and its authenticated sub-properties.

Important — HIPAA Notice: HCMC is a medical device distributor and is not a HIPAA-covered entity. Our website is not intended for the submission or transmission of Protected Health Information (PHI). Please do not submit patient identifying information, clinical details, or any other PHI through our website contact forms, newsletter signups, or any other web-facing channel. If you are a healthcare provider with a clinical question regarding a patient, please contact the treating clinician or the product manufacturer directly.

2. Information We Collect

2.1 Information You Provide Directly

When you interact with our website, you may provide information through:

  • Contact forms: Your name, email address, phone number, employer or organization, professional role, and the content of your message.
  • Newsletter signup: Your email address and, optionally, your name and professional role. Subscription requires a double opt-in confirmation.
  • Rep portal registration: Authorized representatives register with name, business email, employer, territory, and credentials required to authenticate.
  • Partnership and vendor inquiries: Business contact information and organizational details.

2.2 Information Collected Automatically

When you visit our website, our servers and analytics tools automatically record:

  • IP address and approximate location (country/region level)
  • Browser type and operating system
  • Pages visited, time spent, and navigation path
  • Referring website or search engine
  • Device type (desktop, tablet, mobile)
  • Cookies and similar tracking technologies (see Section 7)

3. How We Use Information

HCMC uses collected information for legitimate business purposes, including:

  • Responding to inquiries submitted through contact forms
  • Delivering newsletters, product announcements, and educational content you have subscribed to
  • Providing authenticated access to rep portals and authorized areas of the site
  • Analyzing website performance and improving user experience
  • Complying with legal, regulatory, and audit requirements applicable to medical device distribution
  • Protecting against fraudulent or unauthorized activity

We do not use website-collected information for advertising to consumers, do not sell personal information to third parties, and do not knowingly collect information from children under 13.

4. Who Sees Your Information & Where It Is Stored

Access to information submitted through this site is limited to:

  • HCMC staff with a legitimate business need (sales, customer service, compliance)
  • Service providers who support website operations under confidentiality obligations (listed below)
  • Authorized auditors and regulators when required by law, subpoena, or compliance audit
  • Legal counsel when required to investigate a matter or defend a claim

4.1 Data Storage & Processing Partners

HCMC uses the following third-party service providers. Each operates under its own privacy policy, which governs how it handles data we transmit or entrust to it:

  • Hosting & form submissions: Netlify, Inc. (United States). Submissions through our contact and newsletter forms are processed and stored by Netlify before notification is sent to HCMC staff.
  • Email & collaboration: Google Workspace (Google LLC, United States). HCMC business email and internal document storage.
  • Newsletter delivery (when enabled): MailerLite (or a comparable service). Subscriber email addresses and engagement data are stored by the provider for the duration of the subscription.
  • Domain registration: Porkbun, LLC (United States).

All of the above are U.S.-based providers operating under standard U.S. data-protection practices. HCMC does not currently transfer personal information outside the United States. If that changes, this policy will be updated and affected users will be notified.

We do not sell, rent, or trade your personal information. We do not share your information with advertising networks. We do not monetize site-visit data.

5. Newsletter and Email Communications

If you subscribe to HCMC newsletters or other email communications, you are consenting to receive commercial and educational content related to HCMC's products, services, clinical topics, and company news.

HCMC follows CAN-SPAM Act requirements: every commercial email includes a clear unsubscribe link, our physical postal address, and truthful sender information. We honor unsubscribe requests promptly (within ten business days, and typically within 24 hours).

HCMC uses a double opt-in process: you will not receive content emails until you have confirmed your subscription by clicking a verification link. You may unsubscribe at any time — including before receiving any content email — by using the unsubscribe link in the confirmation email, or by emailing support@honorcodemedical.com.

6. Data Retention

We retain information for as long as needed to fulfill the purposes described in this policy, or as required by applicable law. Specifically:

  • Contact form inquiries: up to 3 years after last contact
  • Newsletter subscribers: until unsubscribed, plus a minimum retention of 5 years for CAN-SPAM audit purposes
  • Rep portal records: for the duration of the representative relationship, plus 7 years for records retention compliance
  • Analytics / aggregate data: retained indefinitely in anonymized form

7. Cookies and Tracking Technologies

Our website uses cookies and similar technologies for:

  • Essential cookies: session management, authentication (required for site function)
  • Analytics cookies: to understand how visitors use the site (optional; privacy-preserving analytics preferred)

You can disable cookies in your browser settings, but doing so may limit functionality (particularly on authenticated portals). We do not currently implement cross-site advertising cookies.

8. Your Rights & Our Practical Approach

Regardless of where you live, HCMC will — as a matter of practice — honor the following requests made in good faith:

  • Access: request a copy of the information we hold about you
  • Correction: request correction of inaccurate information
  • Deletion: request deletion of your information, subject to legal retention requirements (e.g., CAN-SPAM opt-out records)
  • Opt-out: unsubscribe from email communications at any time

8.1 EU / UK Residents — GDPR

HCMC does not actively target or solicit users in the European Union or the United Kingdom and does not currently maintain GDPR-level data-protection infrastructure (Data Protection Officer, Article 30 records, Data Protection Impact Assessments, formal Standard Contractual Clauses). If you are an EU or UK resident and submit information through this site, please be aware that your data will be processed in the United States and HCMC has not certified full GDPR compliance. For the strongest protection, do not submit information to this site; instead contact us by phone or mail.

8.2 How to Exercise Your Rights

Email support@honorcodemedical.com with the subject line "Privacy Request" and a description of your request. We will respond within 45 days. We may ask you to verify your identity before processing your request.

9. Security

HCMC uses industry-standard security practices to protect information, including:

  • TLS encryption for all data in transit (HTTPS)
  • Encryption at rest for stored data in databases and cloud storage
  • Access controls limiting staff access to information on a need-to-know basis
  • Audit logging of administrative actions on authenticated systems
  • Regular security reviews and updates

No online system can be made entirely secure. If we become aware of a data breach affecting your information, we will notify affected parties in accordance with applicable law.

10. Children's Privacy

This website is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected such information, please contact us and we will delete it.

11. Third-Party Links

Our website may link to third-party websites (manufacturer partners, peer-reviewed journals, regulatory resources). HCMC is not responsible for the privacy practices of those sites. Please review their privacy policies independently.

12. Changes to This Policy

HCMC may update this Privacy Policy periodically. When we do, we will update the "Last updated" date at the top of this page and, for material changes, provide notice on our homepage or by email to subscribed users. Continued use of the site after changes become effective constitutes acceptance of the revised policy.
